Justice Ekwo ruled on Monday that Uba was never a candidate in the election because he won an illegally conducted primary election.

The court ordered the Independent National Electoral Commission to remove Uba’s name from the election’s candidate list, and the APC to refund Moghalu the N22.5 million he paid for expressions of interest and nomination forms because the party failed to hold a valid primary.

Uba received 230,000 votes in the now-cancelled direct primary, but only 43,000 votes in the general election, which was won by Prof. Chukwuma Soludo of the All Progressive Grand Alliance.
